Welcome to Prop Movie FX. These Terms of Service ("Terms") govern your access to and use of our website, product purchases, customer accounts, quote requests, custom orders, communications, services, and any other interaction with Prop Movie FX.

For purposes of these Terms, "Prop Movie FX," "we," "us," and "our" refer to Cinematic Designs, Inc. DBA Prop Movie FX.

By accessing our website, placing an order, creating an account, requesting a quote, submitting a custom order, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or purchase our products.

1. Overview

Prop Movie FX is an online prop house supplying props, replica-style items, costume accessories, special-effects products, training aids, production supplies, collectibles, and related merchandise.

Our products may be used for film, television, theater, photography, music videos, content creation, cosplay, conventions, haunted attractions, escape rooms, training, displays, events, collecting, and other lawful creative, professional, educational, recreational, or business purposes.

Some products may be realistic in appearance or may have functional characteristics appropriate to their product category. Products must be used only for their stated purpose and in accordance with all applicable laws, warnings, instructions, and safety requirements. Unless expressly stated otherwise, replica-style products are not genuine firearms, official credentials, screen-used items, or other authentic articles.

By purchasing or using our products, you agree to use them lawfully, safely, responsibly, and only for appropriate purposes.

2. Lawful Use of Products

All products sold by Prop Movie FX must be used only for lawful purposes.

You agree not to:

• Use any product to commit or facilitate a crime
• Use any product for fraud, theft, robbery, threats, intimidation, harassment, deception, assault, or other unlawful conduct
• Use a realistic-looking prop or replica in a way that could reasonably cause panic, fear, confusion, or a law-enforcement response
• Display, brandish, carry, transport, conceal, or use any product unlawfully
• Represent a prop, replica, imitation item, or airsoft product as an authentic weapon, official credential, government-issued item, or other genuine article
• Remove, conceal, modify, or defeat required safety markings, orange tips, disclaimers, identifiers, warnings, or other distinguishing features
• Modify any product in a way that makes it more dangerous or unlawful
• Use any product in violation of federal, state, local, or international law, or in violation of venue, studio, production, school, workplace, convention, event, carrier, or transportation rules
• Purchase products on behalf of any person who is legally prohibited from possessing them
• Resell or distribute our products for illegal, deceptive, threatening, or misleading purposes
• Use products in public without taking reasonable safety precautions and obtaining any required authorization

You are responsible for researching and complying with all laws, regulations, and rules that apply to your location and your intended use.

We reserve the right to refuse, cancel, restrict, report, or investigate any order or activity that we believe may involve unlawful intent, fraud, misuse, or safety concerns. We may cooperate with law enforcement, payment processors, carriers, government agencies, venues, or other appropriate parties when legally required or reasonably necessary.

3. Eligibility and Age Restrictions

By using our website or placing an order, you represent that you are at least the age of majority in your jurisdiction or that you are using the website with the consent of a parent or legal guardian.

Certain products may carry additional age restrictions depending on product type, shipping destination, applicable law, carrier rules, payment-provider rules, or manufacturer requirements. You may be required to confirm your age or provide age verification before an order is accepted or shipped.

You may not purchase an age-restricted product for a minor or for any person prohibited from possessing it. Not all products sold by Prop Movie FX are suitable for children.

Our website is not intended for children under 13, and we do not knowingly sell to children under 13.

4. Customer Accounts

You may be able to create or access a customer account through Shopify, Shop, passwordless login, Google sign-in, or other supported authentication methods.

You are responsible for maintaining the confidentiality of your account access and for all activity conducted through your account.

You agree to provide accurate and current account and order information.

We reserve the right to suspend or restrict account access if we suspect fraud, misuse, unauthorized access, chargeback abuse, unlawful conduct, or violations of these Terms.

5. Product Information

We make reasonable efforts to display product details, descriptions, photos, pricing, availability, and shipping information accurately.

However, we do not guarantee that all product descriptions, images, prices, or other website content will be error-free, complete, current, or identical to the final delivered product.

Products may vary in color, finish, texture, size, weight, material, shape, weathering, aging, paint application, mold lines, surface details, manufacturer changes, hand-finishing, packaging, or production batch. Product images may also vary due to photography lighting or screen settings.

Handmade, hand-finished, painted, weathered, breakaway, foam, rubber, resin, molded, or customized products may vary slightly from photographs or from one unit to another. Product dimensions and weights may be approximate unless expressly guaranteed.

A realistic appearance does not mean a product is identical to a genuine weapon, licensed replica, screen-used item, or official product. Products described as "inspired by," "replica-style," "movie-style," "cosplay," or similar are not necessarily officially licensed or exact reproductions.

We reserve the right to correct errors, update product information, change pricing, limit quantities, substitute packaging, or discontinue products at any time without prior notice.

6. Orders and Acceptance

Placing an order does not guarantee acceptance of the order.

We reserve the right to refuse, cancel, hold, or limit any order, including but not limited to orders involving:

• Suspected fraud
• Suspected unlawful intent
• Product-misuse concerns
• Age-verification issues
• Payment issues
• Chargeback history
• Incorrect pricing or listing errors
• Inventory limitations
• Shipping restrictions
• Legal restrictions
• High-risk or unusual order activity
• Manufacturer restrictions
• Carrier restrictions
• Address-verification issues
• Requests that may create safety, intellectual-property, policy, or reputational concerns

We may request additional identification, billing verification, age verification, intended-use information, or other reasonable documentation before fulfilling an order.

If we cancel an order after payment has been captured, we will issue a refund where appropriate.

7. Payment

We accept the payment methods displayed at checkout or approved on an invoice.

Payments may be processed by third-party payment providers such as Shopify Payments, PayPal, Stripe, Shop Pay, or other supported processors. We do not guarantee that every payment method or processor will always be available.

We do not store full payment card details on our own servers.

You agree to provide accurate billing and payment information, and you authorize us or our payment processor to charge your payment method for products, shipping, taxes, duties where collected, rush fees, customization fees, design fees, reshipping fees, and other clearly disclosed charges.

Fraudulent disputes, false chargebacks, or misuse of payment systems may result in account restrictions, collection activity, submission of evidence to payment processors, or legal action.

8. Shipping, Delivery, and Risk

Shipping times and costs vary based on destination, selected shipping method, order contents, inventory, production time, and carrier availability.

Estimated delivery dates are not guarantees.

We are not responsible for delays caused by:

• Shipping carriers
• Customs
• Weather or natural disasters
• Security inspections
• Incorrect or incomplete addresses
• Failed delivery attempts
• Refused packages
• Import restrictions
• Government actions
• Labor disruptions
• Events outside our reasonable control

Some orders may require additional processing time for customization, production, manufacturer fulfillment, quality inspection, restricted-product review, address verification, age verification, oversized packaging, or special handling.

You are responsible for confirming whether a product may legally be shipped to, imported into, possessed in, or transported through your jurisdiction. We may cancel any order that cannot legally or safely be shipped.

International customers are responsible for any duties, taxes, brokerage fees, customs charges, import permits, or other destination-country requirements, and for any seizures or inspections conducted by destination-country authorities. Except where applicable law requires otherwise, Prop Movie FX is not responsible for packages that are delayed, rejected, confiscated, destroyed, returned, or seized by customs or government authorities because of destination-country laws or restrictions.

Additional shipping charges may apply to reship orders returned to us because of incorrect addresses, refused delivery, failure to collect, unpaid duties, customer unavailability, or destination restrictions.

Risk of loss and title pass in accordance with applicable law. Nothing in these Terms limits any rights you may have regarding products that are lost, damaged, or not delivered.

9. Returns, Refunds, and Exchanges

To request a return, you must contact us within 7 calendar days after delivery regarding any return, defect, damage, missing item, or fulfillment issue. Reporting an issue or requesting a return does not automatically mean that the return, refund, exchange, or replacement is approved. All requests remain subject to our Return Policy and applicable law.

All returns must follow the separate Return Policy published on our website, which is incorporated into these Terms. Eligibility for a return, refund, replacement, or exchange may depend on the condition and category of the product.

We may require photos, video, packaging images, shipping-label images, manufacturer labels, serial numbers, additional information, or a return authorization before approving or processing any return, refund, replacement, or exchange.

Products must generally be returned unused, unworn, unaltered, and in their original packaging, unless the product arrived defective or damaged.

The following may not be eligible for refund, replacement, or exchange:

• Custom, personalized, made-to-order, or special-order products
• Clearance or final-sale products
• Rush orders
• Opened consumables
• Used SFX makeup or other hygiene-sensitive products
• Worn costume accessories
• Products altered, painted, cut, modified, repaired, or damaged by the customer
• Airsoft products that have been used, loaded, fired, modified, disassembled, or had safety markings altered
• Products used during filming, photography, productions, conventions, events, training, performances, or content creation
• Items damaged by misuse or improper storage
• Orders shipped to an address incorrectly provided by the customer
• Orders delayed by the shipping carrier
• Buyer's remorse, where excluded by the Return Policy
• Orders where the customer selected a shipping method that did not meet their deadline

Shipping charges are generally non-refundable unless the issue was caused by our team.

Return shipping costs, restocking fees, or deductions may apply where disclosed in the Return Policy or permitted by law.

Our receipt of a returned product does not automatically guarantee approval of a refund, replacement, or exchange. We reserve the right to deny any request that does not comply with these Terms or the Return Policy, or that appears fraudulent, abusive, or unreasonable.

10. Custom and Personalized Orders

Custom and personalized work may include logos, names, text, graphics, artwork, colors, decals, labels, packaging, engraving, printing, painting, weathering, aging, dimensions, materials, product modifications, original designs, or other customer-requested features.

By submitting artwork, logos, images, names, trademarks, text, or other materials to us, you represent and warrant that you have the legal rights and permissions necessary to use those materials.

You agree not to submit materials that:

• Infringe copyrights, trademarks, trade dress, publicity rights, privacy rights, or other rights of any third party
• Misrepresent affiliation, endorsement, sponsorship, or licensing
• Violate any law
• Contain unlawful, defamatory, obscene, threatening, hateful, fraudulent, or harmful content

We reserve the right to refuse any custom order request for legal, safety, ethical, intellectual-property, technical, production, reputational, or misuse concerns.

Custom orders may require design fees, setup fees, deposits, proof fees, rush charges, minimum quantities, revision fees, additional-production charges, or other applicable fees. Charges will be communicated through the product listing, quote, invoice, proof process, or other written communication.

Screens, proofs, renders, and digital previews may differ slightly from the finished physical product.

Your approval of a proof constitutes approval of all visible design details, including spelling, grammar, names, dates, colors, dimensions, layout, placement, and artwork. Prop Movie FX is not responsible for errors that you approved.

Once a custom order, proof, invoice, or production authorization is approved, or once production or procurement begins, the order may not be cancelled, refunded, or changed except at Prop Movie FX's discretion.

11. Product Safety and Intended Use

Our products are intended for theatrical, film, television, photography, cosplay, display, training, entertainment, collecting, or other lawful uses appropriate to the specific product.

You are responsible for:

• Reading product descriptions before purchase and use
• Following all warnings and manufacturer instructions
• Providing proper supervision
• Storing products safely
• Transporting products safely
• Using appropriate protective equipment
• Checking products before each use
• Determining whether a product is suitable for your intended application
• Obtaining any required venue, employer, studio, property-owner, or event approval
• Following all local laws and regulations

Products must not be used to threaten, strike, injure, deceive, or intimidate others.

Never display realistic-looking props in public without appropriate precautions. Where appropriate, notify relevant production staff, security personnel, property owners, event organizers, or law enforcement before using or displaying a prop. Treat all props cautiously, because third parties may mistake them for genuine weapons or dangerous items.

Products must not be altered in ways that create unsafe conditions.

To the fullest extent permitted by law, Prop Movie FX is not responsible for harm caused by misuse, negligent handling, unauthorized modification, failure to follow warnings, unlawful use, improper supervision, or use of a product outside its intended purpose.

12. Airsoft, Replica, and Realistic-Looking Products

Certain products we sell or may sell, including airsoft guns and realistic-looking replica products, may be subject to federal, state, local, or international laws and restrictions.

Before purchasing, you are responsible for confirming all applicable:

• Minimum-age requirements
• Possession laws
• Transportation laws
• Storage requirements
• Public-display restrictions
• Orange-tip or other marking requirements
• Import rules
• Venue policies
• Shipping restrictions

You may not remove, paint over, conceal, modify, or defeat any orange tip, marking, coloration, or other safety feature where doing so is prohibited by applicable law or would make the product unsafe, deceptive, or unlawful.

Except where legally permitted and appropriately authorized, these products must not be carried openly, displayed in public, brought to schools, airports, government buildings, or other restricted locations, or used in any way that may cause alarm.

We may decline or cancel shipments to restricted destinations.

Product images, names, descriptions, and packaging do not guarantee that a product is legal in every jurisdiction. You assume responsibility for the lawful possession, transportation, storage, and use of these products.

13. Breakaway, Stunt, SFX, and Consumable Products

Breakaway props, stunt items, SFX makeup, theatrical materials, and consumable products may require professional knowledge, testing, supervision, protective equipment, controlled conditions, or trained personnel to be used safely.

Descriptions such as "breakaway," "stunt," "soft," "foam," or "rubber" do not mean a product is incapable of causing injury.

Inspect all products before use. Products should not be used directly on or near people unless the product is designed for that purpose and proper safety procedures are followed.

For makeup, adhesives, cosmetics, prosthetics, theatrical blood, and other skin-contact products:

• Review all ingredients and instructions before use
• Perform a patch test where appropriate
• Stop use immediately if irritation occurs
• You are responsible for accounting for allergies, sensitivities, sanitation, and suitability for each user

Prop Movie FX does not guarantee that any product is suitable for a specific stunt, effect, performer, surface, environment, or production method.

14. Conventions, Events, Venues, and Travel

Convention, event, studio, theater, school, workplace, airline, airport, hotel, venue, and local-government policies vary and change frequently.

Purchasing a product from Prop Movie FX does not guarantee that the product will:

• Pass a weapons check
• Be admitted into a convention
• Be permitted on a set
• Be accepted by security personnel
• Be allowed on an aircraft
• Be permitted in checked or carry-on baggage
• Be legal at your destination

You are responsible for checking all applicable rules before purchasing, traveling, or attending an event.

Except where applicable law requires otherwise, Prop Movie FX is not responsible for denied entry, confiscation, travel disruption, missed events, or other losses resulting from third-party policies.

15. Intellectual Property

All content on our website, including text, photos, videos, graphics, logos, product photography, product designs, original prop designs, artwork, packaging, product names, branding, layouts, website design, instructions, marketing materials, and custom-design concepts, is owned by or licensed to Prop Movie FX and is protected by copyright, trademark, trade dress, and other intellectual-property laws.

You may not copy, reproduce, distribute, modify, sell, exploit, scrape, or create derivative works from our content without prior written permission.

Purchasing a product does not grant you the right to:

• Reproduce the product
• Manufacture copies of the product
• Create molds or scans of the product
• Digitally reproduce the product
• Resell unauthorized copies
• Use Prop Movie FX branding
• Claim ownership of the product's design

Prop Movie FX does not claim ownership of third-party trademarks, characters, franchises, logos, or licensed properties. Where products are inspired by genres, eras, characters, or familiar designs, all third-party names and marks remain the property of their respective owners. Prop Movie FX is not affiliated with, endorsed by, or sponsored by any third-party rights holder unless expressly stated.

16. User-Submitted Content

If you submit reviews, photos, videos, testimonials, comments, production stills, or other content to us, tag us on social media, or otherwise share content publicly in connection with our products, you grant Prop Movie FX a non-exclusive, royalty-free, worldwide license to use, reproduce, repost, display, edit for formatting, and share that content for marketing, advertising, promotional, educational, and commercial purposes.

Prop Movie FX is not required to use any submitted content and may remove content from our platforms at our discretion.

You are responsible for having permission from any visible persons, photographers, production companies, copyright owners, or other rights holders appearing in or associated with the content you submit.

You may contact us regarding removal requests. We will review removal requests in good faith, but we do not guarantee removal where continued use is legally permitted.

17. Prohibited Uses

You may not use our website, products, or services to:

• Violate any law or regulation
• Commit fraud, threats, intimidation, robbery, harassment, assault, or deception
• Create public panic
• Misrepresent a prop, replica, or imitation item as genuine
• Impersonate law enforcement, military, emergency personnel, government officials, or other authorities
• Infringe intellectual-property rights
• Upload malicious code or interfere with website functionality
• Attempt unauthorized access to our systems
• Scrape, copy, or misuse our website content
• Submit false, misleading, or fraudulent customer information
• Engage in chargeback abuse
• Purchase products for persons prohibited from possessing them
• Evade age, location, shipping, or legal restrictions

We reserve the right to cancel orders, refuse service, restrict access, preserve evidence, report activity, or take legal action if we believe these Terms have been violated.

Prop Movie FX may sell, distribute, source, dropship, or otherwise offer products manufactured or fulfilled by third parties. Third-party product warranties, instructions, packaging, specifications, and policies may apply to those products.

Our website may also use or link to third-party services, including Shopify, Shop Pay, payment processors, shipping providers, analytics providers, advertising platforms, social platforms, authentication providers, manufacturers, and fulfillment partners.

We do not control third-party websites, services, manufacturers, carriers, payment processors, social platforms, or applications, and we are not responsible for their content, policies, actions, or practices. Links to or availability of third-party products or services do not constitute endorsement unless expressly stated.

Your use of third-party services may be subject to their own terms and privacy policies. We do not guarantee uninterrupted availability of any third-party service.

19. Disclaimer of Warranties

Our website, products, and services are provided on an "as is" and "as available" basis, subject to applicable law.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee:

• Uninterrupted website access

• Complete accuracy of all descriptions or images at all times
• Exact color or finish matching
• Suitability for every production, stunt, costume, venue, convention, training exercise, or creative use
• Acceptance of any product by any venue or authority
• Legality of any product in every jurisdiction
• Delivery by a specific date
• Compatibility with other products
• That products cannot cause injury if misused
• That replica-style products are exact, officially licensed, or screen accurate unless expressly stated
• That third-party products will remain unchanged by their manufacturers

Nothing in this section disclaims any warranty that cannot legally be disclaimed under applicable law.

20. Limitation of Liability

To the fullest extent permitted by law, Prop Movie FX and its owners, directors, officers, employees, contractors, agents, suppliers, manufacturers, fulfillment partners, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of our website, products, or services.

This includes, but is not limited to, lost profits, lost revenue, production delays, missed shoots, missed events, denied convention entry, travel disruption, reputational harm, lost opportunities, data loss, property damage, product misuse, carrier delay, customs action, or third-party claims.

To the fullest extent permitted by law, our total liability for any claim relating to an order shall not exceed the amount you paid for the specific product or order giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above limitations may not apply to you. Nothing in these Terms limits or excludes liability for intentional misconduct or any other liability that cannot be limited or excluded under applicable law.

21. Indemnification

Subject to applicable law, you agree to indemnify, defend, and hold harmless Prop Movie FX, Cinematic Designs, Inc., and our owners, directors, officers, employees, contractors, agents, suppliers, manufacturers, fulfillment partners, and service providers from any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys' fees, arising from:

22. Fraud Prevention, Safety Review, and Law Enforcement

We may review, hold, verify, refuse, cancel, or report orders or activity involving:

• Suspected fraud
• Stolen payment information
• Chargeback abuse
• Suspected unlawful intent
• Restricted destinations
• Suspicious quantities
• Mismatched billing and shipping details
• Reshipping services
• False information
• Threatening communications
• Product-misuse concerns
• Attempts to bypass age, location, shipping, or legal restrictions

We may preserve and share relevant information with law enforcement, government agencies, payment processors, financial institutions, carriers, insurers, manufacturers, platforms, or other appropriate parties when permitted or required by law.

23. Cancellations by Prop Movie FX

We may cancel or modify an order before fulfillment due to:

• Inventory problems
• Pricing errors
• Listing mistakes
• Supplier cancellation
• Product discontinuation
• Safety concerns
• Legal restrictions

• Fraud concerns

If we cancel an order or item, your remedy will generally be a refund of the amounts paid for the cancelled items, except where another remedy is required by law.

These Terms, together with the incorporated policies published on our website — including the Privacy Policy, Return Policy, and Shipping Policy — and any written custom-order agreement or invoice, constitute the entire agreement between you and Prop Movie FX regarding the relevant transaction.

Where expressly stated, specific written terms in an accepted quote, invoice, custom-order agreement, or purchase order will control over conflicting general website terms for that particular transaction.

29. Changes to These Terms

We may update or change these Terms at any time.

Any updates will be posted on this page with a revised "Last Updated" date. Updated Terms apply from their effective date and are not intended to apply retroactively to transactions completed before that date, except as permitted by law.

Your continued use of our website after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.

30. Governing Law and Venue

These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Any disputes arising from these Terms, our website, products, or services shall be handled in the appropriate state or federal courts located in Miami-Dade County, Florida, unless applicable consumer law requires otherwise.
